Update 3 for Section 301 Trade Actions on Chinese Products

Further to our informational notice of August 10, 2018 we would like to provide you with an update to the ongoing Section 301 Investigations and Trade Actions covering products of Chinese origin.

Stage 3: Proposed US$ 200 Billion Trade Action to be Implemented 9/24/18

Further to the USTR Press Release 091718 and USTR Notice of modification of action please be advised that the President has ordered an additional 10% ad valorem duty on imports of items with HTS#’s contained in the TARIFF LIST – SEPTEMBER 17, 2018. The updated list contains 5745 of the original 6031 tariff lines proposed.

The additional 10% duty will become effective for goods entered for consumption, or withdrawn from warehouse for consumption, on or after September 24, 2018. In addition, the President has indicated that the additional duty rate for these items will increase from 10% to 25% effective January 1, 2019.

Stage 1: Initial US$ 34 Billion Trade Action, Exclusion Requests due October 9, 2018

The products covered in this stage, set out in Annex A of  Docket Number USTR-2018-0018, were subject to an additional duty of 25% as of July 6, 2018. Exclusion requests are being accepted by the USTR. Information related to the exclusion process can be found at the following link. Exclusion requests for this stage must be submitted to the USTR by October 9, 2018.

Stage 2: Supplemental US$ 16 Billion Trade Action, Exclusion Requests Due December18, 2018

The products covered in this stage, set out in the Stage 2 List, were subject to an additional duty of 25% as of August 23, 2018. Exclusion requests are now being accepted by the USTR. Information related to the exclusion process can be found at the following link. Exclusion requests for this stage must be submitted to the USTR by December 18, 2018.
